Sars 'rogue unit' report: EFF, Mkhwebane lose ConCourt appeal against Gordhan
JOHANNESBURG – The Economic Freedom Fighters (EFF) and Public Protector Busisiwe Mkhwebane on Friday morning lost their Constitutional Court appeal of a High Court ruling over the so-called South African Revenue Service (Sars) “rogue unit” case.
Their action related to a recommendation made last year by Mkhwebane against Public Enterprises Minister Pravin Gordhan.
The public protector penned a report into the Sars intelligence unit, saying it was unlawfully constituted and conducted illegal intelligence gathering operations at the tax collection agency.
Mkhwebane recommended the President Cyril Ramaphosa should take action against Gordhan who was the commissioner of Sars at the time.
Gordhan obtained an interdict from the High Court in 2019 to suspend the order of remedial action while he took the finding on review.
Mkhwebane and the EFF then lodged an appeal against that order at the Constitutional Court.
